How openly.work handles disputes ?

To use the dispute resolution service, clients must purchase Quality Assurance. This feature allows clients to protect their investment by disputing the quality of a freelancer’s work if it fails to meet agreed-upon standards.

All freelancers are automatically granted a Refund Appeal by default. However, openly.work may revoke this privilege if there is suspicion of fraud or if further verification is required. In such cases, freelancers will need to purchase a Refund Appeal to retain the ability to dispute a client's refund request. This feature gives freelancers the means to challenge refund claims.

When a dispute is raised, openly.work first seeks a non-binding resolution, aiming to reach a mutually acceptable payment amount through negotiation between the client and the freelancer. If this attempt does not succeed, the dispute progresses to a binding resolution. In this phase, an impartial third-party arbitrator reviews the evidence presented by both sides, investigates the situation, and makes a final decision on whether the client’s reasons for withholding payment are valid. The arbitrator's decision is binding and enforceable.

Can clients sign their own contracts with freelancers ?

Yes, clients can sign their own contracts with freelancers. openly.work provides an optional Dispute Resolution service, which includes a standard contract for a low fee.

If both parties choose to manage disputes independently, they can opt out of the openly.work Quality Assurance (which covers Dispute Resolution service) and use their own contract if they wish. With this option, neither party pays fees to openly.work. However, please note that in this case, the platform will release the payment immediately after the freelancer submits their work.

How many fees does Openly.work has ?

openly.work offers 2 optional fees in its structure:

  • Quality Assurance: Available to clients, this protects their investment by allowing them to dispute the quality of work.
  • Confidentiality Agreement: This fee is charged to keep project deliverables private; otherwise, all work remains public.

All of these fees are optional, and users can access the platform completely free without using them.

If a dispute resolution is triggered and can't be settled by mediation, both the client and freelancer will have to buy the arbitration fee which is only refunded to the winner. Arbitration fees are paid to 3rd party independent services.

For Clients

Why should I buy Quality Assurance ?

To ensure you don't fall into scams, with Quality Assurance you can revoke the final work.

What is the evaluation period ?

Once the freelancer submits their completed work, a evaluation period begins.

During this period, the client has the opportunity to assess the work's quality and decide whether to approve or reject it.

  • Automatic Payment: If the client doesn't provide feedback or take action within the evaluation period, the payment is automatically released to the freelancer.
  • Client Rejection: If the client rejects the work, they must provide specific feedback and negotiate a solution with the freelancer.
  • Dispute Resolution: If a dispute arises, openly.work's dispute resolution process can be initiated.

Can I set customizable contracts ?

openly.work lets you create your own contract agreements. This gives you the flexibility to choose the legal jurisdiction that governs your agreement, or craft specific terms that address your unique project requirements. Please contact team@openly.work for more details.

The delivery date has passed and no work has been delivered, what should I do?

Always communicate with the freelancer first. If you dont get a reply, you can go to the job page and click "Cancel" to get your money back.

How do I change the review end date ?

Once the task has initiated, only freelancers can modify the review end date.

How to cancel an in-progress task ?

While clients cannot cancel in-progress tasks, that can be done by the freelancer. If you need to terminate a project early, you can negotiate a partial payment with the freelancer. This payment can be applied towards the work completed to date.

Please note: This is a mutually agreed-upon arrangement and should be discussed directly with the freelancer.

What if I don't buy Quality Assurance ?

Openly.work offers flexibility for experienced freelancers and clients who prefer to manage disputes independently. Here's how it works:

  • Custom Contracts: You can choose to use your own contracts outlining your dispute resolution procedures.
  • Immediate Payment Release: Upon project delivery openly.work will immediately release the payment.

Important Note:

While opting out offers cost savings and control, it's crucial to understand that:

Openly.work Won't Mediate Disputes: If a disagreement arises, openly.work will not be involved in mediation or arbitration.
Increased Risk: You and the client are solely responsible for resolving any disputes. This can be time-consuming and potentially lead to legal involvement.

Recommendation:

Openly.work strongly recommends considering the potential risks before opting out of dispute resolution. However, we understand the needs of experienced users who may prefer this approach.

How to quit an In-Progress Job ?

If you need to quit a job that's already underway, here's the best approach:

  • Communicate Clearly: Contact the client as soon as possible to explain the reasons for the cancellation. Be respectful and professional.
  • Agree the payment: Negotiate a mutually agreeable solution, such as:
    • Partial Payment: If you've completed some of the work, you might be able to request partial payment.
    • No Payment: If the cancellation is due to circumstances beyond your control, you and the client might agree on no payment.
  • Close the job: Set the aggreed payment, zero if no payment, and submit to close the job. If there's any completed work, you can add it to the submition too.
  • Provide Feedback: Once you've submitted the work, you'll have the opportunity to leave feedback for the client. Encourage the client to do the same. This can help other freelancers or clients make informed decisions in the future.

Remember: Open and honest communication is key when canceling a job. By following these steps, you can minimize any negative impact on your professional reputation and potentially maintain a positive relationship with the client.

The evaluation period has ended without approval, what should I do?

Why is evaluation period important ?

If by the end of the evaluation period the delivery has not been approved or rejected, the escrow payment is released to the freelancer.
