Terms and Conditions:

Purpose of the application: The application aims to provide a technological service for interconnecting people to contact each other and play private tennis matches, participate in private tennis events and tournaments as described in these terms and conditions, using technological devices that enable technological connectivity.

Agreement to terms and conditions: By accessing and using the services, the user confirms their agreement to be bound by these terms and conditions. If the user does not agree with the terms and conditions, they cannot access or use the services. Ludus reserves the right to terminate the terms and conditions immediately or any service, or to generally cease offering or deny access to the services or any portion of them, at any time and for any reason.

Modification of terms and conditions: The user acknowledges and accepts that Ludus may modify these terms and conditions from time to time, which will take effect upon their publication in the application. The user's continued access and use of the services after the publication signifies their consent to the modified terms and conditions.

Ownership and use of the application: The application and services are owned by Construclerna S.A., and any updates, new versions, information related to the services provided by Ludus, as well as all documentation and material provided or made available by Ludus. The user acknowledges that the use of the application and services does not grant the right to use the logos, trademarks, trade names, product names, or services of Construclerna S.A.

User Account: The user must register and maintain a user account. To register, the user must provide personal information such as name, address, cellphone number, age, as well as an acceptable payment method for Ludus. The user agrees to maintain accurate, complete, and up-to-date information in their account. The user is responsible for all activity that occurs under the account and agrees to maintain the security and confidentiality of the username and password at all times.

Age restrictions: This web application is
not intended for children under the age of 12, and the use of the application by children under 12 is prohibited. Children under 12 who want to be part of the application must directly contact the administration with their legal representative.

Only individuals over the age of 12, through their legal representative, and individuals over the age of eighteen (18) are allowed to use this application. Therefore, the user disclaims and exempts Ludus from any use by individuals who do not meet the requirements specified in these terms and conditions for the use of the application and participation in private events and tournaments.

Third-party use of the application and services is not permitted. The user cannot assign or transfer the account to any person or entity. The user agrees to comply with applicable laws when using the services and the application and agrees to use them for lawful purposes. Ludus may require proof of identity or any method of identity verification to access or use the application and services, and agrees that access to the application and services will be denied if the user refuses to provide proof of identity or any other identification method.

Ludus will make its best efforts to prevent the registration of minors. If you are under 12 years old, do not attempt to register on the application or provide personal information. No person under 12 years of age should provide personal information to the application.

Restrictions: The user may not remove any copyright, trademark, or ownership notices from any portion of the services, reproduce, modify, create derivative works based on the software, distribute, license, lease, sell, resell, transfer, publicly communicate, transmit, or otherwise exploit the services, except as expressly permitted by Ludus. The user may not reverse engineer or disassemble the services, attempt unauthorized access to disable any aspect of the services or related systems or networks.

Access to networks and devices: The user is responsible for obtaining the data network to use the services and the necessary hardware and devices to access and use the services and applications and updates. Ludus does not guarantee that the application will work on a particular device or hardware, which is accepted by the user. The services may be subject to delays and operational issues due to internet usage and electronic communications.

Ludus is not responsible for the reliability, availability, or timeliness of the services or that the services will be uninterrupted or error-free. The user acknowledges that Ludus only provides the facilities for interconnection, and it is their responsibility and risk to use the services of the application.

Subscription fee and payment: By using the application, the user agrees to pay an annual subscription fee published in the application, which is non-refundable, to be paid through acceptable payment methods by Ludus. If the primary payment method is expired, invalid, or otherwise unavailable for charges, the user agrees that Ludus may use the secondary payment method on their account if available. Payments are non-refundable unless otherwise determined by Ludus.

Authorization of use: Ludus grants the user the right to use the application on their technological device solely for the purpose of using the services provided by Ludus. The user declares that they will access and use any content, information, and related material available on the application for personal and non-commercial use. Rights not expressly granted in these terms and conditions are reserved to Ludus and its licensors.

User statements regarding the application: For all trainings and events involving participants under 18 years of age, they must be accompanied by a representative, which is known and accepted by the user.

The user declares that they are aware and accept that this application is designed to connect with other users interested in playing tennis, at their own account, responsibility, and risk, in private events on tennis courts freely chosen by the users, which are not operated, leased, or owned by Ludus.
