--- tags: Endgame Coordination --- # EG.11 -- Arbitration Scope Designed to provide a fair and transparent process for resolving disputes within Maker. ## Scope ``` - Does this include intra-MetaDAO conflict? - Do actors need to opt-in? In advance? ``` ## Panel (Arbitrators) The arbitration scope consists of a panel of arbitrators who are knowledgeable about the subject matter of the dispute and have no personal interest in the outcome. ``` - Is the panel permanent? - Are "experts" consulted? Fair Process? ``` ## Process 1. The parties involved in a dispute would first agree to submit their case to the arbitration scope. This agreement could be made in writing or through some other means, such as by signing a smart contract that specifies the terms of the arbitration. ```do we want parties to "stake" to submit a proposal?``` 2. The parties would then submit their case to the arbitration scope, along with any relevant evidence and arguments. 3. The arbitration panel would review the case and determine whether it meets the necessary requirements for arbitration. If the case is accepted, the arbitrators would proceed to hear the arguments and review the evidence presented by both sides. 4. The arbitrators would then consider the evidence and arguments, consult experts, require extra data, and make a decision based on the merits of the case. The decision would be binding on both parties and would be issued in writing, along with an explanation of the arbitrators' reasoning. ## Appealing the decision / Escalation `Do we want this? This could involve holding a vote (MKR holders?) or some other decision-making process to determine the best course of action. ` `MKR holders as the supreme court?` ## Enforceability The arbitration scope could also include mechanisms for enforcing the ruling, such as: - penalties - ability to freeze assets or future streams - impose other sanctions on a party who refuses to comply. ## Templates / UI The arbitration scope could have specific requirements for the information that needs to be provided, such as a certain format for presenting evidence or a limit on the length of arguments. ## Objective ### Resolve Disputes Overall, an arbitration scope would aim to provide a fair and transparent process for resolving disputes within a decentralized organization, helping to maintain trust and stability within the organization. ### Strengthen the Scopes Incorporating feedback into the rules and procedures of a DAO arbitration scope would help to ensure that the scope remains fair and effective, and that it continues to evolve and improve over time. This could help to maintain trust and stability within the organization, and could also make the scope more responsive to the needs of its members. ## Operating in times of "peace" One way to incorporate feedback into the scope would be to have a process for submitting suggestions for changes to the rules and procedures. This could involve creating a forum or other platform where members of the DAO can submit their ideas and suggestions. The arbitration panel or other designated group could then review these suggestions and decide whether to implement them. --- [GovAlpha Doc](https://docs.google.com/document/d/10mxTTEh6ddA_xnvqxGoe4VLw_pthWch3icaYVL8XMpw/edit#heading=h.a9vd2o6vjkot)
