# Ophuichi Constitution

## Preamble of the Constitution
> For the greater good for the People of Ophuichi and the posterity, our liberty and for the highest standards of democracy within the Monarchy of Ophuichi, we the People unite to form, write, and confirm this Constitution of the Ophuichi Confederation.

## Article 1, Type of Government and Highest Authority
The Ophuichi Confederation shall be recognized as a constitutional monarchy, the Highest Authority within the Ophuichi Confederation shall be His Majesty, sushiodevs.

## Article 2, Executive Operations

### Section 1, Executive Head of State
1. The authority and title of Executive Head of State shall be vested in the King or Queen of Ophuichi or otherwise stated by the king or queen, and also or otherwise in absence, a selected Designated Executer of Power.
2. The EHoS is recognized as the Royal in Chief of the Armed Forces, and has supreme authority over the Armed Forces, and therefore having the ability to mobilize any assets, declare the state in an emergency, a war, or terror.
3. A Designated Executer of Power shall have limited power, and the President of Ophuichi shall fill in the shoes of EHoS in their position, though they still have their current authority and power. The designated executer of power shall be a Commander in Vacancies, and therefore not having supreme authority of the Armed Forces, and can only declare the state as State of Emergency.
4. The EHoS will have the power of negotiation, and contact any other foreign states and discuss treaties and other topics relating to international affairs.
5. The EHoS shall have a limited power on appointments. The EHoS can appoint anyone to any government position for a limited amount of time and until the position can be properly be fufilled. The Designated Executer of Power cannot appoint anyone to any government position as this authority can be abused.
6. The Designated Executer of Power can be impeached for abusing their authority by the Legislative Branch, the DEop Shall have the right to a trial and the trial shall be presided by the highest authority within the Judicial Branch. The Legislative Branch will watch the trial, summon witnesses, gather evidence and proof against and not against the DEoP, and vote to impeach the DEoP.
7. The EHoS will have the authority to issue executive orders, and they can be striked down by the Legislative Branch by a unanimous vote.
8. The EHoS shall have the authority to all information, classified or otherwise under the Executive Branch and the Title.

### Section 2, President of The Confederation
1. There shall be a President of the Confederation, and is the Head of State, and Head of Government, or in their absence, the Vice President or those who are inheritors of the Office.
2. The title of President shall be an electable position with the exception of A2-S1-5, and they shall have a term of 4 months. A person can run for 2 terms.
3. No person shall be able to be President unless they are 91(3 Months) days old on Roblox, and must and shall be a citizen of the Confederation, and not convicted of 1 and more high crimes.
4. In case of the President is unable to execute his duties of President of the Confederation due to death, resignation, or inability to do so, the President may enact Article 2, Section 2, Subsection 4, or in this case, this part, the inheritance and sucession of the office of President shall be as follows:

Vice President
Speaker Pro Tempore
Secretary of Defence
Secretary of National Security
Attorney General
Secretary of State
Secretary of Health
Secretary of Immigration

Incase of resignation, the resignated president shall be barred from holding any government office for the rest of the term.

5. The President of the Confederation shall be the Commander in Chief of the Armed Forces of the Confederation, therefore that the President shall have the authority to mobilize any asset, command the Armed Forces, and declare the state as, in an emergency, war, or terror. The President can also order all Law Enforcement Agencies to maintain civil order and sanity if needed.
6. The President will have the authority to issue and nullify executive orders, and referendums. EOs and Rs can be strike down by the CLA or Supreme Court based on the following. CLA can strike down EOs or Rs by a supermajority vote within the CLA. The Supreme Court may declare EOs or Rs unconstitutional or abusive, and all sitting justices/judges will vote, if a supermajority aye vote is reached, the EO or R is striked down.
7. The President is recommended to appoint a Secretary of State to preform negotiations, meetings, etc for Foreign Affairs. The President will have the authority to preform foreign affairs and recommend ambassadors, and Confederation Diplomats to the CLA.
8. The President shall give recommendations to the CLA about appointing those to government offices before going with appointments. The President should follow the opinions of the CLA about appointments and candidates for government offices. Appointments may include Cabinet Members, branch members, etc.
9. The President shall have the authority and access to all information below the executive branch, classified or otherwise.

### Section 2, Vice President of the Confederation
1. There shall be a Vice President of the Confederation, which will also serve as the Speaker of the Legislative Assembly, and shall be the deputy of the President.
2. A vice president candidate shall be chosen in the Presidential Elections Period by the Presidential Candidate. Upon entering the Executive Branch and their respective offices, the now Vice President shall serve at the pleasure of the President. If there is a vacancy in the position of Vice President, the President will have the power to appoint one and the person being appointed must pass confirmation from the Legislative Assembly by a majority vote before taking upon office.
3. A vice president's term shall match up with the length rest of the President's current term, therefore once the President's 4 month term is up, the vice president's term shall also end.
4. The Vice President shall execute and perform their duties prescribed to them by law, and also duties delegated by the President.
5. The Vice President shall have the authority to assemble the Cabinet to remove the President if the President is assumed not able to carry out their duties.
