2. 轉型正義，以德國爲例，套用台灣
轉型正義是民主國家對過去獨裁政府實施的違法和不正義行為的彌補，通常具有司法、歷史、行政、憲法、賠償等面向。其根本基礎在還原歷史真相。
評議者通常著重在執行轉型正義的單位拘泥於「究責」，而非改變體制避免重蹈覆轍、與最終的和解、撫平傷痛。

德國轉型正義主要可以分兩塊談一部份是如何面對**納粹屠殺**，另一部份則與台灣較類似，是**東德共產政府對人民的高壓統治**
轉型正義（transitional justice）翻譯自英語，在德國並沒有這樣的說法，德國人用的詞是克服過去（Vergangenheitsbewältigung）與清理過去（Geschichtsaufarbeitung），前者主要說的是如何站在傷痕上往前看，後者則是強調對過去的處理。鄭嘉瑩由此做了一個小的結論：「無論說法是什麼，講的都是同一件事：要有過去，才會有未來。」
藍士博認為：「歷史事件如果沒辦法被感受、被閱讀、被理解、被銘刻在心裡的話，就像是不存在一樣。」
李思儀認為，轉型正義是一個過程，最終目標是追尋台灣社會所需要的正義。

**高風險團體**：慈善團體、宗廟教會、非營利組織、立法委員
他們財務透明度也不太好
公務人員突然拿大筆金額
現在洗錢中最常用的是美金

**洗錢步驟**
洗錢的錢要是非法所得
1. 處置：前置犯罪所得比如詐騙、貪汙、販毒，且要融入金融體系
2. 多層化：透過金融交易(一般次數較多)，比如開洗衣店
3. 整合：

抓壞人

我們能做的：疑似洗錢通報、通報

大額、疑似洗錢交易申報(不管洗錢大小銅板也算)、不管有沒有完成交易
ex：業務侵占
注意：跟銀行交易沒完成也可以報

當鋪：現金往來頻繁的行業，高風險行業
公司股權結構：了解公司背後是誰在控制
拿**護照**來開戶的顧客風險較高，因為護照較難判別真偽
**律師、會計師**最懂幫人避稅，風險較高

**知道錢的來源很重要**
資本額跟金流對不起來-有問題
存摺跟支票交易對不起來-有問題
外匯也要有跟單的文件
存大量金額換支票然後退票-造成退票金額遽增國家經濟表現差，破壞金融秩序

**制裁**
經濟制裁：財政、金融、貿易等領域的制裁
不遵守國家制裁的話會被該國銀行拒絕往來

**態樣**
分為量化及非量化
量化可累計，系統可控管
非量化不可計系統不可控管，比如：一個保險箱多人使用、來開戶的阿伯身邊一堆年輕人
流量：薪水
尤其是私人銀行的錢留要特別注意
以風險為本，高風險要多花時間成本，低風險不太花時間成本來檢查
高風險顧客突然存入大筆金額會跳警示出來

控制權人是看自然人不是看法人
