# State of Scott Constitution 2021

## Article. 1. - Human Rights

We shall have the right to freedom of speech & freedom to express their opinions peacefully, no law shall be made that prevents the right to have an opinion on something.

We shall have the right to carry/own a firearm for self defense upon obtaining a firearm licence. Although, may be subject to arrest if brandishing/misusing their firearm along with a removal of their licencing.

We shall have the right to an attorney. If we cannot afford one, the judiciary/state must use the public defenders office within the department of justice to provide one by court appointment.

We shall have the right to a fair court trial following the judicial proceedings without any double jeopardy or corruption/biasness within the jury or presiding officer.

We shall have the right to run for public office if we meet the requirements stated in Article NUMBER regarding elections, requirements and responsibilities.

We shall have the right to protest as long as it is peacefully, violent free and on public property.

We shall have the right to be searched and/or to have our property searched unless presented a court order or the officer has reasonable cause.

We shall have the right to not be unlawfully detained by any Law Enforcement Officer.

We shall have the ability to prosecute anyone for any valid reason deemed by the State Courts.

No law shall be made that impedes the rights of the people, which are listed above.

## Article. 2. - Oaths
###### The Governor shall take the following oath:
> I do solemnly swear (or affirm) that I will faithfully execute the Office of the Governor of the State of Scott and will to the best of my ability, preserve and defend the People and the Constitution.

###### The Lieutenant Governor shall take the following oath:
> I do solemnly swear (or affirm) that I will faithfully execute the Office of the Lieutenant Governor of the State of Scott and will to the best of my ability, preserve and defend the People and the Constitution.

###### All members of the state legislature shall take the following oath:
> I do solemnly swear (or affirm) that I will create and vote on bills which will help, I will not be bias or break any of the rights of our citizens, and will to the best of my ability, preserve and defend the People and the Constitution.

###### The judiciary shall take the following oath:
> I do solemnly swear (or affirm) that I will be impartial when deciding and presiding over case, I will perform all the duties incumbent upon me as under the Constitution and laws of the State of Scott defined by passed legislature.

###### Cabinet/Department Leadership shall take the following oath:

>I do solemnly swear (or affirm) that I will faithfully execute the Office of the RANK/DEPARTMENT, and will to the best of my ability, preserve and defend the People and the Constitution.

## Article. 3. - The Judiciary
The judiciary shall include two courts; the district court and supreme court. Both tasked with executing the duties of a judge/justice within their respectful court.

The Supreme Court shall have jurisdiction in all cases of appeal on civil and criminal matters, and expungements.

The District Courts shall have original jurisdiction in all civil matters and all suits involving criminal charges.

The Supreme Court shall consist of up to nine justices, one of which being the Chief Justice.

The District Court shall consist of an undefined number of judges.

All members of the judiciary are mandated to be nominated by the Governor then confirmed by the State Senate in a majority vote.

The District Court and Supreme Court may issue Arrest Warrants along with Search Warrants.

Search Warrants shall be overseen and conducted by the Rockhill County Sheriff's Office. The County Sheriff may decided who is qualified to do these warrants. Search Warrants include the search of the defined person and their known property. If required, the Rockhill County Sheriff's Office may seize or destroy any illegal items defined by passed legislature via any means nessasary including; seizure of the car, blowing the car by firing several rounds at the front and storing the illegal items in their department vehicle.

Arrest Warrants may be conducted by any avaliable Law Enforcement Officer. These warrants include the order to arrest and bring before a judge the defined user, who is accused of an offense or violation based on the document/warrant provided to the Law Enforcement Officer.

### Article. 4. - Legislature
The Scott State Senate, shall hereby be established and recognised as the legislative body of the State of Scott. The legislature shall be tasked with the creation, voting and passing of legislation as well as being representatives of the people in government matters and voting on government nominations. There shall be 8 seats in the State Senate and shall be held by one councillor each. One seat shall be held by the President Pro Tempore.

All passed legislature that has been closed, deleted, or is otherwise inaccessible to read shall not remain effective unless ammended within 14 days. If not ammended, shall be nullified.

All legislation is required to be voted upon during a senate session, a majority vote shall allow the bill be to signed by the Governor in order to be put into effect.

Senators shall serve a term of four (4) months, after this time shall be removed from office and required to be re-elected. There is currently no limit on how many times you can become a senator.

In order to become a senator, you must be qualified therefore meeting the requirements. You must have an account age of one hundred and fifty days old or more to ensure there are no alternative accounts accepted into the senate along with a requirement of the rank Citizen or above for at least 48 hours as of your declaration being submitted. Additionally, the applicant will be required to provide a valid picture of Multi-factor authentication, also known as 2FA along with an age of 13 or above in real life and no safechat being enabled on your ROBLOX account. During the full screening process you may be subjected to a background check to confirm you own no stolen assets, you are not an alternative account and other checks which will not be disclosed. This means your inventory must be set to public along with a picture of your criminal records. Anyone barred from holding office by the Election Committee may not be eligable to run in elections for the senate.

The President of the Senate shall author the Standing Rules which shall be passed by a majority senate vote. Ammendments shall be voted on and ammended by senators themselves. All bills shall be finalized in PDF format before being placed onto the senate docket.

The senate may not hold any office of the Governor, Lieutenant Governor, Attorney General or Chief Justice, they may run and resign upon being elected into the State Senate.

## Article. 5. - Impeachment

The Senate may review articles of impeachment if they pass the senate shall be given to the Supreme Court for an impeachment hearing which is presided by the Chief Justice. During this time, the senate can vote for a revocation of the accused office, responsibilities, title and powers invested within them by the state.

The impeachment process is long therefore a revocation may only last two (2) weeks at the maximum.

If impeached, that person is required to give up all power and be removed of their role within that office.

If the position is elected, the line of succession shall be used OR the Governor shall be tasked with the appointment of a temporary person. An election shall be held on the next Saturday or Sunday by the Election Committee.

## Article. 6. - Elections

A committee shall be established as the "Election Committee". This shall be 5 people, including the founders/developers of the state who are tasked with the management, creation and overseeing the election process.

All eligable citizens shall have forty eight (48) hours or less to declare they are running for that specific role in the election.

All candidates shall have twenty four (24) hours to campaign in order for citizens to obtain the knowledge of their candidates, their plans and more.

All citizens may vote for twenty four (24) hours via any method the Election Committee deem proper.

The Election Committee are mandated to publish and vote upon rules for each election.

The Election Committee have fourty eight (48) hours to reply to the Governor regarding elections before they may permanently appoint someone to furfil the duties of the vacant office.

All botted, disqualified and non-eligable vote/voters must be not counted.

The committee have fourty eight (48) hours to publish the results after the election has ended.

## Article. 7. - State BAR

The State BAR was established to ensure that the Citizens of this state receieve proper legal representation.

The State BAR is tasked with setting/publishing the guidelines for BAR certified attorneys to ensure no legal malpractice is conducted and that all attorneys have the law knowledge to assist the State Citizens.

Herein, the "Chairperson", shall be defined as the person who runs, maintains and oversees the State BAR.

The State BAR Chairperson shall run the State BAR at the citizens pleasure.

The chairman/chairwoman is responsible for the BAR certifications, they have the power to suspend, revoke, blacklist and add BAR certifications as they wish.

They may blacklist anyone whom they deem unfit to be an attorney. They also oversee the Institute Classes for people who wish to be educated about the law system and become an attorney or judge in the state.

## Article. 8. - Department of Justice

The Department of Justice shall be tasked with assisting the state with it's legal needs. There shall be several departments established within the Justice Department including but not limited to; Public Defenders Office, Criminal Prosecution Office and more.

The department shall employ BAR certified attorneys to assist with prosecuting criminals and defending citizens who cannot afford attorneys.

The Attorney General shall maintain the Criminal Code.

The Attorney General shall oversee the department and obtain automatic entry into the state BAR.

## Article. 9. - Law Enforcement

The following departments; shall enforce the law. Anyone within those departments shall be defined as a Law Enforcement Officer (LEO).

Each Department shall train and certify all peace officers within their department before full acceptance into the department.

All of the Department Heads shall obtain a position within the Governor's Cabinet and shall be nominated by them. Although, the Sheriff is exempt due to being an elected person.

## Article. 10. - Enforcement

This constitution shall go into effect immediately upon passage by the senate and citizens and shall remain in effect until nullified.

This constitution does not require the Governors signature.

Any unconstitutional acts committed by any government or executive branch member is grounds for impeachment.

Any bill which collides with this constitution or any bill which violates the constitution shall hereby be null and void.

The constitution shall be enforced by all departments and agencies.

Anything that interferes with the game, it's development, machanics, systems by bills, legislation or any other means must be approved by the Development Team.

The Development Team can nullify any legislation after a majority vote if it effects the development, reputation or any other reasonable cause of the group/games.

This Constitution may be amended at any time by the senate following a majority citizen approval rating and it being made before going into effect. No new Constitution shall replace this Constitution.
