--- ## Section. I. Preamble We the legislators and citizens of The Galactic Republic write and compose this constitution to form a free representative union of planets and their intrinsic parties, to create a more stable and secure government, to protect the civil liberties and rights of all species, to promote and preserve our welfare and security, to maintain a Republic of justice and equality, and to maintain the sovereignty of our Republic and its Grand Army do write and legitimize this constitution for The Galactic Republic and all planets who it holds sovereign. --- ## Section. II. Separation of Powers ### §. 2.1 • Branches of Government In an attempt to establish a balanced & just government, Galactic Republic powers shall be split into 3 branches of government. #### **§. 2.1.1 • The Executive Branch** The Executive Branch will be comprised of the Cabinet of the Supreme Chancellor & the Republic Strategic Command. #### **§. 2.1.2 • The Legislative Branch** The Legislative Branch will be comprised of members of the Galactic Senate selected by an application process, dedicated to the production of legislation and the protection of the Constitution. #### **§. 2.1.3 • The Judicial Branch** As the final arbiter of the law, the Galactic Court acts as a Guardian & Interpreter of the Constitution, defining what is and is not constitutional through court processions. ### §. 2.2 • Division of Power Each branch of government maintains a separate role in the Galactic Republic. This article will go in-depth into what branches of government withhold powers, although not limited to, these powers can commonly be known as: 1. The Power of Legislation 2. The Power of the Militia 3. The Power of the Courts 4. The Power of Declaration 7. The Power of Pardon #### §. 2.2.1 • The Power of Legislation The Power of Legislation is the power to produce, edit, enact and enforce legislation to amend the constitution or code of law in the Galaxy. These powers are delegated specifically to the Legislative Branch although with exceptions. The Power to produce, edit and enact legislation is specific to the branch of legislation, however the power to enforce legislation onto the Galactic Republic, as long as enacted by the branch of legislation, or more commonly known as "The Galactic Senate", is entitled to the executive branch, ensuring that legislation is enforced and upheld with usage of this power. Although the Vice Chancellor is a member of the Galactic Senate, they are classed as a member of The Executive Branch and are therefore not entitled to the ability to produce legislation, but to rather enforce and uphold it. #### §. 2.2.2 • The Power of the Militia The Power of the Miltita, or to command and restructure the militia, is dedicated to the The Executive Branch. This means that all legislation affecting the militia must be sponsored by atleast **one** member of the Executive Branch whom is currently holding capacity as a military leader, i.e a Commander, rather than a Speaker of the Senate. The Militia may also be restructured at the decision of the Executive Branch with notification required to the legislative branch. #### §. 2.2.3 • The Power of the Courts The Power of the Courts, or the power to sentence, incriminate, or acquit a member of the Galactic Republic, alongside the power to edit, interpret, and uphold the Galactic Constitution is reserved specifically for the Galactic Court. There are no exceptions to this rule, and any changes of the Galactic Court structure must be implemented by the Chief Justice's sponsor, alongside a majority vote between the Justices of the Galactic Court, alongside the vote of the Vice Chancellor. This means that to edit the structure of the Courts, you'd need approval from the Chief Justice, Vice Chancellor, and atleast 1/2 of the current Justices. #### §. 2.2.4 • The Power of Declaration The Power of Declaration, or the power to declare war on another state, is reserved for the Galactic Senate of the Republic, and the people of the Republic. This means that to declare emergency and invest emergency powers to the Supreme Chancellor, there would have to be an a 3/4 vote of the Senate, declaring the Galactic Republic in a state of war. Once the Galactic Republic is presented in a state of war, the following abilities are designated to the Supreme Chancellor, or if the Supreme Chancellor is not present, The Supreme Commander: - The Ability to fill a position within the Republic military without formal notice. - The Ability to make drastic changes to the Republic military without Informing the Galactic Senate - The Ability to propose war legislation to the Senate. - The Ability to remove members of the strategic command without Informing the executive branch. #### §. 2.2.5 • The Power of Pardon The power of pardon, or the power to pardon an incriminated individual is reserved for limited people, those people shall be known as the following: The Galactic Courts The Supreme Chancellor The Vice Chancellor The Supreme Commander The power of pardon also extends out into the power to veto legislation, which is reserved for similar people, although the Galactic Court requires the legislation to be deemed "unconstitutional" by a minimum of 1/3 of the current Justice's (Chief included). ## Section. III. Executive Leadership ### §. 3.1 • Executive Division and Overview The Office of the Supreme Chancellor, also known as Supreme Command, will consist of all executive leadership of The Galactic Republic. The Office is to be headed by the Supreme Chancellor and consist of a Supreme Commander, Grand Marshal, Vice Chancellor, Grandmaster of the Order, Director of Security, Head Trainer and Fleet Admiral (TO POSSIBLY BE AMENDED) The powers of the Office of the Supreme Chancellor are vested in the enforcement of legislation, the execution of executive acts, orders or mandates, the pardoning of those convicted by the Galactic Courts, and directing developmental and military initiative. Republic Command is to consist of the Lower executives of the Cabinet of the Supreme Chancellor. ### §. 3.2 • Upper Executives of the Cabinet of the Supreme Chancellor The Upper Executives of the Cabinet of the Supreme Chancellor also known as **Republic High Command** are to consist of the Supreme Chancellor and his supporting roles, the Supreme Commander and Vice Chancellor. The Supreme Chancellor of the Galactic Republic is to rule as the supreme power in the Republic holding supreme jurisdiction over the Office of the Supreme Chancellor, Republic High Command, the Galactic Senate, and the Galactic Courts. The Supreme Chancellor may appoint a new chancellor should they retire or delegate how a new appointment will be decided. If the Supreme Chancellor is unable to discharge the duties of their office, the immediate acting Chancellor will be the Vice Chancellor. If the Vice Chancellor is also unable to discharge his duties, the line of succession will be activated. The Supreme Commander is to function as a supporting role of the Supreme Chancellor holding supreme jurisdiction over Republic High Command, The Republic Military and the Republic Navy. The Supreme Commander is to be appointed or removed by the Supreme Chancellor. #### Additional powers vested in the Upper Executives of the Office of the Supreme Chancellor include: - The Upper Executives may authorize any executive act they deem necessary with or without approval from members of Republic High Command. - The Upper Executives may authorize the reform, expansion, or removal of branches of the Republic. - The Upper Executives may promote, demote or replace members of Republic Command and other branches as they deem fit. - The Supreme Chancellor may oversee Republic development and holds authority over the management or developmental incentives and projects. ### §. 3.3 • Lower Executives of the Office of the Supreme Chancellor The Lower Executives of the Cabinet of the Supreme Chancellor shall consist of the Grand Marshal, Speaker of the Senate, Fleet Admiral, Grandmaster, Director of Security, Head Trainer. The Supreme Chancellor and/or Supreme Commander may delegate responsibilities or tasks to any member part of the cabinet. ### ***The Grand Marshal*** The Grand Marshal is to function as an advisory aide and military overseer to the Office of the Supreme Chancellor holding overall jurisdiction over The Republic Army. The Grand Marshal is to be appointed or removed by the Upper Executives. #### Additional powers vested in the Grand Marshal include: - Presiding over the Grand Army of the Republic's sectors, divisions, and leadership. - Function as an advisor to the Republic Navy and provide instruction, advice, and/or other forms of support to its assets. - Promoting, demoting, or replacing members of Sector Command and other military branches with consultation from the Office of the Supreme Chancellor. - Investigating and gathering information in relation to military performance, standards, and quality directive for reform and/or presentation to the Office of the Supreme Chancellor. ### ***The Fleet Admiral*** The Fleet Admiral is to function as an advisory aide and military overseer to the Office of the Supreme Chancellor holding jurisdiction over The Republic Navy. The Fleet Admiral is to be appointed or removed by the Upper Executives. #### Additional powers vested in the Fleet Admiral include: - Presiding over the naval sectors, divisions, and leadership. - Function as an advisor to the Grand Army of the Republic and provide instruction, advice, and/or other forms of support to its assets. - Promoting, demoting, or replacing members of Sector Command and other military branches with consultation from the Office of the Supreme Chancellor. - Investigating and gathering information in relation to military performance, standards, and quality directive for reform and/or presentation to the Office of the Supreme Chancellor. ### ***The Speaker of the Senate*** The Speaker of the Senate is to function as a legislative advisor to the Office of the Supreme Chancellor holding jurisdiction over the Galactic Senate and as a director for Republic affairs. The Speaker is appointed into the position by the Galactic Senate. #### Additional powers vested in the Speaker include: - Vetoing legislation with limitation, issuing direct reforms to the Galactic Senate and its domain, handling the disciplining of Senate Officials, and impeaching and removing senators and other officials on the cases of treason, corruption, gross misconduct, incompetence and/or a successful vote of no confidence. - Appointing senators in the event of a vacancy with a suitable replacement. - Appointing the Head Secretary and Committee Chairmens (in a state of emergency.), Judiciaries and other Court Officials. - The Speaker holds the authority to break tied votes held by the Galactic Senate or other legislative faculties. ### ***Director Of Security*** The Director of Security is to function as an Intelligence aide to the Office of the Supreme Chancellor holding jurisdiction over National Security and Republic Intelligence. The DoS is to be appointed or removed by the Upper Executives. #### Additional powers vested in the Director of Security include: - Authority to suspend military and Civillan authority for Investigations related to Treason and Misconduct. - The Power to Declare the Republic In a state of Internal or External Security Breach. - Classify Information to the Galactic Senate, Republic High Command and Republic Command. (In State of Security Breach) ### ***Grandmaster Of the Order*** The Grandmaster is to function as an advisory aide to the Office of the Supreme Chancellor holding jurisdiction over the Jedi order. The Grandmaster is to be appointed or removed by the Upper Executives or voted Into the position by the Jedi Council. #### Additional powers vested in the Grandmaster include: - The appointment of Jedi Generals and Jedi Commanders to legions. - Authority to regulate how TJO members will be Included within the Republic Military ### ***Head Trainer*** (RESTABLISHED) The Head Trainer is to function as an advisory aide to the Office of the Supreme Chancellor holding jurisdiction over the Republics Officer Academy, ARC Training Program and ARF Training Program. The Head Trainer is to be appointed or removed by the Upper Executives. ### Section. IV. Galactic Senate ### §. 4.1 • Oversight The Senate shall have the right and authority to oversee the functionings of the Galactic Republic, however the Senate should consider the opinion of Republic officers and work with them. ### §. 4.2 • The Galactic Senate Rules The Senate shall have the powers to create rules to govern itself, which shall be amended by a simple majority vote. It may lend power to standing committees via their charter to conduct oversight and certain litigation & policy setting, and to conduct Senate oversight. The Senate cannot bind itself, except by this constitution. (ie, the Senate cannot pass a law which it cannot change in the future, or one that limits its powers.) The Senate shall pass no law that directly contradicts the constitution. No order shall be made from any officer, or any policy made by any council (Senatorial or not), that directly contradicts the constitution. Senators are not removed for inactivity but when inactive, they are automatically excluded from votes. (Ie if a bill needs 11/20 senators to pass and 10 senators are on inactive notice, the bill will only need 6/10 senators to pass). Inactive senators become active again by voting. Inactivity is described by being away from Senate votes for long periods of time or not voting when ample opportunity has been given. Senate rules may expand upon this. The Vice chancellor as chairman of the Senate shall execute the Senate's orders and directives. ### Section. V. Bill of Rights ### §. 5.1 • Right to a fair trial Every citizen within the Galactic Republic will have the right to a fair trial within the Galactic Court System. As stated by the Court System if any of the following instances a citizen or member of the armed forces may face any offense, before their removal or exilement from the Galactic Republic. ### §. 5.2 • Service within the Republic Every citizen within the Galactic Republic is given the right to enlist within the Republic Armed Forces. Those that enlist into the Republic Armed Forces may only join either the Republic Navy or Republic Army and are allowed be in both branches of the Armed Forces. The Republic Intelligence will ensure that the candidates for the Army and Navy are screened to ensure they are not within any hostile factions such as Death Watch and the Confederacy. ### Section. VI. The Galactic Senate vs The Jedi Order The Galactic Senate does not directly command nor orders the Jedi Council or its members however it is generally accepted the Jedi Order obeys the requests and commands of the office of the Supreme Chancellor. Some members of the Jedi will be integrated with the Republic Armed Forces serving as Jedi Generals to show their commitment to the Galactic Republic. The Senate cannot make laws governing the internal workings of the Jedi order that do not concern them. Jedi who are part of the Republic military must follow the appropriate chain of command. ### Section. VI. Republic Intelligence Republic Intelligence shall operate as a seperate entity from the Republic Army and Republic Navy and will conduct Investigations within the Republic only on grounds of suspected Treason, Uprise, Coup etc. Republic Intelligence will be lead by the Intelligence Director who is appointed by the Director of Security. ### Section. VIII. Consitutional Amendments The Senate may create and ratify amendments to this constitution if they reach a 3/4th majority vote. The Speaker of the Senate cannot veto a Constitutional Amendment. All passed amendments will go to the Upper executives for approval.
