Crimes (Legalisation of Incest) Amendment Bill === ### 1. Title This Act may be cited as the Crimes (Legalisation of Incest) Amendment Act 2019. ### 2. Commencement This Act comes into force on the day after the date it receives the Royal Assent. ### 3. Purpose The purpose of this Act is to legalise the sexual connection between two consenting adults where it would be considered incest, in cases where contraceptives are used or in cases where there is no risk of pregnancy. ### 4. Principal Act This Act amends the Crimes Act 1961 (the principal Act). ### 5. Interpretation **contraceptive** has the same meaning as contraceptive in section 2 of the Contraception, Sterilisation, and Abortion Act 1997. ### 6. Section 130 amended (1) Replace section 130(2) with the following— > (2) Every one of or over the age of 16 years who commits incest without the use of a contraceptive is liable to imprisonment for a term not exceeding 10 years. >> (a) This subsection shall not apply in cases where there is no risk of pregnancy, such as buggery, cunnilingus, anilingus, and fellatio.
