Criminal Law Types Criminal law is a set of regulations that, if broken, can result in penalties and/or imprisonment. It is divided into categories based on the potential penalties for breaking the law. These are disorderly person, misdemeanour, and felony. Felony. A serious offence, like murder, is considered a felony. A criminal conviction almost always results in incarceration. Misdemeanor. An attack, for example, would be considered a misdemeanour. A misdemeanour conviction will certainly result in an alternative punishment that does entail incarceration. Unorganized individual. A small infraction like generating a disturbance that typically carries a fine is being a rowdy person. Criminal law infractions may affect healthcare providers. Several of the more prevalent criminal statutes to which they are subject are • Fraud. When a healthcare facility or professional purposefully files false medical invoices to Medicare, Medicaid, or health insurance companies, this is intentional deception that causes harm to another person. • Batteries This occurs when a person is intentionally touched without the patient's permission, such as when a medical operation is carried out on a patient without the patient's permission. • Agression. This is the deliberate threatening of doing harm to someone, such as pointing a hyperemic syringe in the direction of a patient. The patient gets hurt when the medication is injected into them, even though the medication in the syringe aids the patient. Before a patient is seen by a healthcare practitioner or before having a procedure done on them, they make them sign a consent form in order to prevent assault and battery. • Involuntary confinement. This is the willful and illegal detention or restraint of a person by another person. Hospital beds include side rails as restraints. Raising all four side rails makes it impossible for the patient to get out of bed, which is against the law and amounts to wrongful imprisonment. False detention also includes the unwillingness to release a patient from a medical facility.
