# **The Imperial Charter** ###### tags: `Imperial Charter` # Title I. Establishment ## Chapter 1. Authority ### § I.1.01. Imperial Charter This Imperial Charter will form the basis of Imperial Law and shall be considered supreme in every manner. ### § I.1.02. Imperial Sovereignty His Imperial Majesty, The Emperor is the absolute seat of power and authority within the Empire, even above the authority of the Imperial Charter, and His sovereignty shall not be infringed upon by any person, document or law. # Title II. Construction ## Chapter 1. Definitions ### § II.1.01. Definitions In construing these statutes and each and every word, phrase, or part hereof, where the context will permit: **(1)** The terms "his imperial majesty", "his majesty", "your majesty", "the emperor", is refering to the absolute seat of power, and supreme ruler, of the Empire. **(2)** The singular includes the plural and vice versa. **(3)** Gender-specific language includes the other gender and neuter. **(4)** The word “person” includes individuals, children, firms, associations, joint adventures, partnerships, estates, trusts, business trusts, syndicates, fiduciaries, corporations, and all other groups or combinations. **(5)** The word “writing” includes handwriting, printing, typewriting, and all other methods and means of forming letters and characters upon paper, stone, wood, or other materials. The word “writing” also includes information which is created or stored in any electronic medium and is retrievable in perceivable form. **(6)** The word “oath” includes affirmations. **(7)** Reference to any office or officer includes any person authorized by laws, orders, ordinances, or the Imperial Charter to perform the duties of such office. **(8)** The words “public body,” “body politic,” or “political subdivision” include cities, towns, villages, the senate, and all other political bodies in this empire. **(9)** The term "file" means to be turned over to the presiding court judge or subsequent clerk of court. **(10)** The term “natural barrier” when used with reference to the possession of real estate includes any cliff, river, sea, gulf, lake, slough, marsh, swamp, bay, lagoon, creek, saw grass area, or the like. **(11)** The words “registered mail” include filed evidence of discord messages. **(12)** Whenever the terms “agriculture,” “agricultural purposes,” “agricultural uses,” or words of similar import are used in any of the statutes of the empire, such terms include aquaculture, horticulture, and floriculture; aquacultural purposes, horticultural purposes, and floricultural purposes; aquacultural uses, horticultural uses, and floricultural uses; and words of similar import applicable to agriculture are likewise applicable to aquaculture, horticulture, and floriculture. **(13)** The word “minor” includes any person who has not attained the age of 18 years. **(14)** The term “veteran” means a person who served in the active military, naval, or air service and who was discharged or released under honorable conditions only or who later received an upgraded discharge under honorable conditions. **(15)** The term "judge" means an officer authorized to rule on law. **(16)** The term "agent" means one authorized to work on behalf of the Empire. **(17)** The term "citizen" means a person who holds the rank of 'Citizen', or higher, within the Empire and, therefore, has been legally acknowledged as a registered citizen in the Empire. **(18)** The term "judgment" means the decision of a court regarding the rights and liabilities of parties in a legal action or proceeding. **(19)** The word "conviction" means a person who has been tried in a court of law and has been handed a guilty verdict. **(20)** The term "executor" means a person who is executing (signing) a formal document. **(20)** The word "served" means to notify a person of important legal, or legislative, information via a form or document. **(21)** The term "oversector" shall be considered to mean the same as a "priority sector" which are made up of several sectors. For the purposes of ROBLOX, it shall mean a variety of "Experiences" or "Places" representing an oversector. The amount of experiences or places that constitute an oversector is set by His Imperial Majesty, The Emperor. **(22)** The term "sector" shall be considered to mean an area of space framed by an artificial boundary for political, economic and military organisation. For the purposes of ROBLOX, it shall mean a ROBLOX "Experience" or "Place" representing a planet. ### § II.1.02. Legal Time In all laws, statutes, orders, rules, and regulations of this empire, relating to the time of performance of any act by any officer or department of this empire, whether in the legislative or judicial branches, or relating to the time within which any rights shall accrue or determine, or within which any act shall or shall not be performed, by any person subject to the jurisdiction of this empire, it shall be understood and intended that the said time shall be Greenwich Mean Time (GMT +0). ### § II.1.03. Null Law From the promulgation of this completed imperial charter, all former charters or other forms of law shall be declared null and void. # Title III. Organization ## Chapter 1. Concessions and Boundaries ### § III.1.01. Imperial Land Aquisition The Empire may purchase, acquire, hold, own, occupy, and possess such lands within the limits of its boundaries as they shall seek to occupy and hold as sites on which to erect and maintain forts, magazines, arsenals, dockyards, and other needful buildings. ### § III.1.02. Condemnation of land when price not agreed upon If the officer or other agent employed by the Empire to make such a purchase and the owner of the land contemplated to be purchased, as aforesaid, cannot agree for the sale and purchase thereof, the same may be acquired by the Empire by condemnation in the same manner as is hereinafter provided for condemnation of lands for other public purposes, and any officer or agent authorized by the Empire may institute and conduct such proceedings in their behalf. ### § III.1.03. Jurisdiction of lands; ceding land Whenever the Empire shall contract for, purchase, or acquire any land within the limits of the Empire for the purposes aforesaid, in either of the modes above mentioned and provided, or shall hold for such purposes lands heretofore lawfully acquired or reserved therefor, and shall desire to acquire constitutional jurisdiction over such lands for said purposes, the relevant Moff may, upon application made to him or her in writing on behalf of the Empire for that purpose, accompanied by the proper evidence of said reservation, purchase, contract, or acquisition of record, describing the land sought to be ceded by convenient metes and bounds, thereupon, in the name and on behalf of the Empire, cede to the Empire exclusive jurisdiction over the land so reserved, purchased, or acquired and sought to be ceded; the Empire to hold, use, occupy, own, possess, and exercise said jurisdiction over the same for the purposes aforesaid, and none other whatsoever; provided, always, that the consent aforesaid is hereby given and the cession aforesaid is to be granted and made as aforesaid, upon the express condition that this state shall retain a concurrent jurisdiction with the Empire in and over the land or lands so to be ceded, and every portion thereof, so far that all process, civil or criminal, issuing under authority of this state, or of any of the courts or judicial officers thereof may be executed by the proper officers thereof, upon any person amenable to the same, within the limits and extent of lands so ceded, in like manner and to like effect as if this law had never been passed. ### § III.1.04. Doctrine of *Bona Vacantia* Any lands or goods which are ownerless shall automatically cede to the ownership of the Imperial Throne and become property of the Empire. ### § III.1.05. Lands or goods owned by criminals Any land or goods owned by criminals shall, by virtue of the offences committed, become ownerless and shall pass bona vacantia. # Title IV. Civil Liberties and Amendments ## Chapter 1. Preamble ### § IV.1.01. Guarantee of Civil Liberties The undermentioned civil liberties are to be guaranteed to all citizens of the Empire unless they be changed by law or decree. ### § IV.1.02. Removal of Civil Liberties There are instances in which a citizen of the Empire may be stripped of their civil liberties. Those aformentioned instances include, but are not limited to; (1) commission of a offence, (2) investigation of terrorism or treason. ### § IV.1.03. Military Service Enlistment, or commissioning, into a branch of the Empire's military will result in the loss of **freedom of speech, freedom of the press, and the right to personal enterprise.** > The term "commissioning", as used in this section, means the enlistment of a person into the Empire's military as a ranking officer within their unit or branch. [color=#FFFF00] ### § IV.1.04. Notice of Change The amending of Title IV of the Imperial Charter requires a week notice of change prior to its execution. ## Chapter 2. Speech and the Press; Petition ### § IV.2.01. Freedom of Speech Citizens of the Empire shall have the limited right to freedom of speech, and of the press. ### § IV.2.02. Petition Clause Citizens of the Empire shall have the limited right to petition the government for a redress of grievances. ## Chapter 3. Right to Labor and Enterprise ### § IV.3.01. Labor All Citizens of the Empire possess the limited right to serve on empire's legislature and judiciary, as well as serve in the empire's military, in addition to working in the government. ### § IV.1.03. Enterprise Citizens of the Empire possess the right to participate in public and private personal enterprise systems. ## Chapter 4. Searches and Seizures; Warrants ### § IV.4.01. Searches and Seizures Citizens of the Empire possess the limited right to be secure in their persons, houses, papers, and effects, against unwarranted searches and seizures. ### § IV.4.02. Warrants Warrants shall not be granted unless reasonable suspicion is ascertained, supported by oath or affirmation, and such warrants must describe, in particularity, the location(s) to be searched, or the iterms or person(s) to be seized. ## Chapter 5. Double Jeopardy; Self-Incrimination; Due Process; Speedy Trial ### § IV.5.01. Double Jeopardy No one shall be liable to be tried or punished again in criminal proceedings for an offence for which he has already been finally acquitted or convicted in accordance with the law and penal procedure of that Empire. The provisions of the preceding paragraph shall not prevent the reopening of the case in accordance with the law and penal procedure of the Empire, if there is evidence of new or newly discovered facts, or if there has been a fundamental defect in the previous proceedings, which could affect the outcome of the case. ### § IV.5.02. Self-Incrimination Citizens of the Empire shall not be compelled to be a witness against himself. However, adverse inferences may be drawn against him. ### § IV.5.03. Due Process Citizens of the Empire shall not be deprived of life, liberty, or property without due process of law. ### § IV.5.04. Speedy Trial Citizens of the Empire shall be given a speedy trial within a reasonable time period. ## Chapter 6. Amendments ### § IV.6.01. Amendments by His Imperial Majesty, The Emperor His Imperial Majesty, The Emperor may amend the Imperial Charter, in whole or in part, as he sees fit without any restriction. ### § IV.6.02. Amendments by the Imperial Senate The Imperial Senate may amend the Imperial Charter by the following procedure: (1) the proposed amendment is initially put before the Imperial Senate Senate for debate; (2) the proposed amendment is then subsequently considered by the relevant senatorial committee; (3) the proposed amendment is forwarded to the Imperial Ruling Council for approval; (4) the proposed amendment is voted on by the by the relevant senatorial committee; (5) the proposed amendment, once passed, is returned to the Senate floor for a final debate and vote; (6) the passed amendment is sent to His Imperial Majesty, The Emperor who may either approve or reject the amendment. If all stages are successful, the relevant amendment will take effect immediately. ### § IV.6.03. Miscellaneous provisions For successful passage, the amendment requires two thirds of the voting Senators to vote in the affirmative. The Imperial Senate may not veto the rejection of any amendments by His Imperial Majesty, The Emperor. # Title V. The Legislature ## Chapter 1. Authority and Responsibilities ### § V.1.01. Vested Authority All of the legislative powers granted herein shall be vested in the legislature of the Empire, and shall consist, thusfar, of an Imperial Senate. ### § V.1.02. Rules and Punishments Only the Imperial Senate may determine the rules of its proceedings and may punish its individual members for their respective disorderly behavior in accordance with its rules. ### § V.1.03. Senatorial Power This Imperial Senate has the power to: (1) determine their election process; (2) propose, and vote on, legislation; (3) propose, and vote on, amendments to the consistution; (4) directly refer legislation to the Appellate Committee of the Imperial Ruling Council in order to certify as to its compliance with existing constitutional law. ### § V.1.04. Quorum The Imperial Senate shall meet having no less than 12 members present, and should the quorum not be met, the meeting shall be deferred one week and all proposed legislation shall, too, be postponed to the same. ### § V.1.05. Journal The legislature shall keep a journal of all of its voting proceedings, and shall publish the same to the whole legislature. The journal must contain; (1) which laws were discussed, (2) which individuals voted aye or no on discussed legislation, (3) a reminder of the remaining number of sessions until dissolvment of this senatorial term. ### § V.1.06. Absence Upon the absence of a senator at a senatorial meeting, the senator may use the discord voting system to cast their vote for or against proposed legislation. With casting their vote they also must provide a legimate reason for voting aye or nay. If they do not the vote will be nullified. ## Chapter 2. Composition, Election, and Tenure ### § V.2.01. Election The Imperial Senate shall be composed of no greater than 20 senators at any given time and the sitting members thereof shall have sole authority as to govern their own election through the "Procedures and Protocols of the Imperial Senate of the New Order". ### § V.2.02. Tenure The Senate shall have a maximum tenure of no greater than 60 days per term. ### § V.2.03. Senatorial Impeachments Impeachment will be considered a charge of misconduct against a government official. Senatorial impeachment will result in the loss of the official's ability to exercise the powers and authorities of their office, and said official will be permitted to conclude their term without exercising their authority. The Imperial Senate shall have the sole power to try all impeachments against it's members. While sitting for such a purpose, they shall be on oath or affirmation. Should the Speaker of the Imperial Senate be tried, the Procurator of Justice shall preside. No perons shall be convicted without a concurrence of three fourths of the whole senate. All senatorial impeachments shall be withheld adjudication for a period not less than one week and not more than a period of one month while pending a final review of the evidence presented by the Speaker of the Imperial Senate or, in his absence, the Procurator of Justice. > In this instance, the term "absence" is refering to the inability to perform the responsibilities of one's own office. [color=#FFFF00] Impeachment is not a substitue to legal prosecution and, as such, an individual may be legally prosecuted in addition to being impeached. # Title VI. The Judiciary ## Chapter 1. Imperial Bar Council ### § VI.1.01. Function of the Imperial Bar Council It is the function of the Imperial Bar Council to regulate the legal profession within the Empire as well as issuing regulations regarding the conduct of legal professionals. The Imperial Bar Council also handles the registration and examination of prospective Imperial Advocates. ### § VI.1.02. Powers of the Imperial Bar Council The Imperial Bar Council has the following powers: (1) to set regulations for the legal profession which regulates professional conduct and ethics; (2) to admit prospective candidates as Imperial Advocates subsequent successful passing of the required examination; (3) to investigate Imperial Advocates subsequent to a complaint being submitted; (4) to disbar Imperial Advocates subsequent to a complaint being upheld; and, (5) any other powers His Imperial Majesty, The Emperor feels are necessary in the regulation of the legal profession. ### § VI.1.03. Appointment of Members of the Imperial Bar Council Members of the Imperial Bar Council will be elected by members of the legal profession. ### § VI.1.04. Lord President of the Imperial Bar Council The Lord President of the Imperial Bar Council will serve as the leader of the Imperial Bar Council and shall be elected by the members of the Imperial Bar Council who are sitting at the time. The Lord President shall serve in this capacity until such a time as they resign, retire or are removed from office. ## Chapter 2. Imperial Prosecution Service ### § VI.2.01. Jurisdiction The Imperial Prosecution Service has sole jurisdiction in prosecuting criminals. No other person, body or agency may do so without this being approved by the Imperial Prosecution Service. ### § VI.2.02. Appointment of Imperial Prosecutors The Director of Imperial Prosecutions may appoint as many Imperial Prosecutors as he deems necessary to ensure the efficient running of the Imperial Prosecution Service. However, all Imperial Prosecutors appointed must: (1) pass a background check by a relevant intelligence authority; (2) have passed the bar exam; and, (3) be of good character. If any of the above requirements are not met, the candidate must not be appointed. ## Chapter 3. Judicial Power; Tenure; etc. ### § VI.3.01. Judicial Power The judicial power of the Empire shall be vested in the Imperial Ruling Council, and in such inferior courts as may be ordained or otherwise established. The judges of both the supreme, and inferior, courts shall hold their offices during good behavior. ### § VI.3.02. Tenure Judges of the Imperial Court of Justice serve at the pleasure of His Imperial Majesty, The Emperor. ### § VI.3.03. Appointment Judges of the Imperial Court of Justice may only be appointed by His Imperial Majesty, The Emperor, with advice and recommendation from the Imperial Judicial Appointments Commission. ### § VI.3.04. Removal Judges may be removed by the Imperial Senate. The Imperial Senate may vote to remove a sitting judge subsequent to the recommendation of their removal by the Commission for the Preservation of the New Order. ### § VI.3.05. Sitting judges Judges may not sit in multiple courts at one time, for example: a judge within the Appellate Committee of the Imperial Ruling Council may not sit in the Imperial Court of Justice. This may not be overriden by resigning from either court. If you resign from one court to join another, you must wait one calendar month before going to the other court. ## Chapter 4. Imperial Court of Justice ### § VI.4.01. Lord President of the Imperial Court of Justice There shall be a Lord President of the Imperial Court of Justice who shall be the presiding officer of the court. This position will be elected by the members of the court sitting at the time of the election. The Lord President shall serve in this capacity until such a time as they resign, retire or are removed from office. ### § VI.4.02. Function of the Court The function of the Court will be to hear cases before it and provide a ruling that is consistent with both Imperial law and any relevant past precedent, subject to any limitations set within this Charter. ### § VI.4.03. Powers of the Court The court has the power to: (1) order that a particular servicemen be demoted after being convicted of an offence; (2) order that a particular servicemen be dismissed from service after being convicted of an offence; (3) order that a particular convict be reinstated subject to an overturn of their conviction; (4) order that a particular serviceman's rank be reinstated subject to being found not guilty of an offence; (5) order that a citizen's status be revoked after being convicted of an offence. (6) refer a case of a constitutional nature to the Appellate Committee of the Imperial Ruling Council; (7) refer a case of a criminal nature to the Appellate Committee of the Imperial Ruling Council subject to obtaining permission to appeal; (8) any ancillary orders that the court finds necessary; and, (9) any other sanction or remedy His Imperial Majesty, The Emperor thinks just and equitable. ### § VI.4.04. Limitations of the Court The Court will be subject to the following limitations of its judicial power: (1) The Court may not rule on constitutional affairs. Any cases brought before it regarding a public law matter must be referred to the Appellate Committee of the Imperial Ruling Council; (2) The Court may not depart from its past precedent unless the case before it can be sufficiently distinguished from the past decision; and, (3) any other restriction His Imperial Majesty, The Emperor thinks appropriate. ## Chapter 5. Appellate Committee of the Imperial Ruling Council ### § VI.5.01. Function of the Appellate Committee The Appellate Committee functions as the superior court of the Empire. It shall hear appeals and referrals from the Imperial Court of Justice as well as referrals given to it by the Imperial Senate. ### § VI.5.02. Powers of the Appellate Committee The court has the power to: (1) order that a particular servicemen be demoted after being convicted of an offence; (2) order that a particular servicemen be dismissed from service after being convicted of an offence; (3) order that a particular convict be reinstated subject to an overturn of their conviction; (4) order that a particular serviceman's rank be reinstated subject to being found not guilty of an offence; (5) order that a citizen's status be revoked after being convicted of an offence. (6) refer a case of a constitutional nature to the Appellate Committee of the Imperial Ruling Council; (7) refer a case of a criminal nature to the Appellate Committee of the Imperial Ruling Council subject to obtaining permission to appeal; (8) any ancillary orders that the court finds necessary; and, (9) any other sanction or remedy His Imperial Majesty, The Emperor thinks just and equitable. ## § Chapter 6. Imperial Judicial Appointments Commission ### § VI.6.01. Membership of the Commission The members of the Imperial Judicial Appointments Commission must consist of at least: (1) one judge from the Imperial Court of Justice, appointed by the Imperial Ruling Council; (2) one legal professional, appointed by the Imperial Bar Council; and, (3) one layperson; appointed by the Commission for the Preservation of the New Order. As long as the requirements are met, further Commissioners may be appointed on an ad hoc basis. ### § VI.6.02. Judicial appointments process The judicial appointments process will start by the Imperial Judicial Appointments Commission announcing an upcoming or current vacancy within the Imperial Court of Justice. This advertisement will remain open for a reasonable period before the submission process closes. Once applications are in, the Commissioners will consider the candidates' applications and then shortlist the candidates. There is no requirement for any candidates to be selected if the Commissioners feel that no candidate is sufficiently qualified. Once shortlisted, the candidates will be invited for an interview before a panel of the Commissioners. If successful, the Commissioners will send their recommendation to the Commission for the Preservation of the New Order. If approved, the Commission for the Preservation of the New Order will notify the Imperial Judicial Appointments Commission of this, in a reasonable amount of time, who will finally confirm their recommendation to His Imperial Majesty, The Emperor. ## Chapter 7. Clerk of Courts ### § VI.7.01. Function of the Court Clerks It shall be the duty of the Clerks to keep records of court proceedings and rulings to ensure that the Imperial Archives are kept up-to-date. It shall also be the duty of the Clerks to ensure that any paperwork that passes through the court is in order and does not contradict the court's processes. ## Chapter 8. Court Procedure ### § VI.8.01. The Imperial Court Compendium The Imperial Court Compendium shall be the document governing the internal processes, procedures and practices of the Imperial Courts. It is enforceable under the Imperial Charter. # Title VII. Government Agencies ## Chapter 1. Commission for the Preservation of the New Order ### § VII.1.01. Establishment of a Commission for the Preservation of the New Order There shall be a Commission for the Preservation of the New Order. The Commission shall operate as a government agency responsible for a variety of public functions, including but not limited to upholding the Empire's ideology and acting as the Empire's civil service. ### § VII.1.02. The Office of Chairman There shall be such a position as Chairman who will act as the head of the Select Committee and the de facto and de jure leader of the Commission. ### § VII.1.03. The Select Committee There shall be a body within the Commission such as the Select Committee. Its members shall be known as the Lord Commissioners. It shall function to advise the Chairman of the Commission and carry out the day-to-day functions of the Commission's various subsidiaries such as, but not limited to, Imperial Intelligence and the Imperial Security Bureau. The portfolio of each Lord Commissioner shall be decided by the Chairman of the Commission. ### § VII.1.04. Subsidiaries of the Commission The following agencies shall be considered as subsidiaries of the Commission: (1) Imperial Intelligence; (2) the Imperial Security Bureau; (3) COMPForce; (4) the Imperial Civil Service; (5) the Imperial Prosecution Service; (6) the Office of the Inspector General; and, (7) any other agency, department or office that His Imperial Majesty, The Emperor deems necessary. ### § VII.1.05. Powers of the Commission The Commission shall have the power to direct and control the intelligence, law enforcement, bureaucratic and ideological functions under its jurisdiction and any other powers His Imperial Majesty, The Emperor sees fit and proper in the circumstances. ### § VII.1.06. COMPForce There shall be a subsidiary of the Commission known as "COMPForce". COMPForce shall act as the paramilitary branch of the Commission and shall exist to further the Commission's ideological functions by ensuring the loyalty and dedication of Imperial citizens. It shall be headed by a Lord Commissioner of the Select Committee chosen by the Chairman. ## Chapter 2. Imperial Intelligence ### § VII.2.01. Establishment of Imperial Intelligence There shall be such an agency as Imperial Intelligence. It is one of the two security branches within the Empire. It operates as the main intelligence gathering body within the Empire carrying out threat reports among other services for Imperial authorities, ensuring the loyalty of the Empire. ### § VII.2.02. Office for the Director of Imperial Intelligence There shall be such a position as Director of Imperial Intelligence who shall lead Imperial Intelligence under the direction of the Chairman of the Commission for the Preservation of the New Order. ### § VII.2.03. Organisation of Imperial Intelligence Imperial Intelligence may be structured in whatever way the Director sees fit, provided that it effectively executes its duties and primary directives. ### § VII.2.04. Powers of Imperial Intelligence Imperial Intelligence shall have the power to direct and control the functions that are under its jurisdiction and any other powers that His Imperial Majesty, The Emperor sees fit and proper in the circumstances. ## Chapter 3. The Imperial Security Bureau ### § VII.3.01. Establishment of the Imperial Security Bureau There shall be such an agency as the Imperial Security Bureau. The Imperial Security Bureau is one of the two security branches within the Empire. It operates as the main law enforcement body within the Empire, carrying out work to root out potential insurrection, gathering evidence and bringing peace and security to the galaxy. ### § VII.3.02. Office for the Director of the Imperial Security Bureau There shall be such a position as Director of the Imperial Security Bureau who shall lead said Bureau under the direction of the Chairman of the Commission for the Preservation of the New Order. ### § VII.3.03. Organisation of the Imperial Security Bureau The Imperial Security Bureau may be structured in whatever way the Director sees fit, provided that it effectively executes its duties and primary directives. ### § VII.3.04. Powers of the Imperial Security Bureau The Imperial Security Bureau shall have the power to direct and control the functions that are under its jurisdiction and any other powers that His Imperial Majesty, The Emperor sees fit and proper in the circumstances. ## Chapter 4. The Imperial Civil Service ### § VII.4.01. Establishment of the Imperial Civil Service There shall be such an agency as the Imperial Civil Service. It is a purely civilian organisation that advise and assist Imperial officials in the execution of their public duties. It operates under the jurisdiction of the Commission of the Preservation of the New Order. ### § VII.4.02. Office of the Chief Secretary There shall be such a position as the Chief Secretary of the Imperial Civil Service. They shall lead the Civil Service under the direction of the Chairman of the Commission for the Preservation of the New Order. ### § VII.4.03. Organisation of the Imperial Civil Service The Imperial Civil Service may be structured in whatever way the Chief Secretary sees fit, provided that effectively executes its duties and primary directives. ### § VII.4.04. Powers of the Imperial Civil Service The Imperial Civil Service shall have the power to direct and control the functions that are under its jurisdiction and any other powers that His Imperial Majesty, The Emperor sees fit and proper in the circumstances. ## Chapter 5. The Imperial Prosecution Service ### § VII.5.01. Establishment of the Imperial Prosecution Service There shall be such an agency as the Imperial Prosecution Service. The Imperial Prosecution Service is the only public prosecuting authority within the Empire. Its function will be to prosecute criminals based on evidence provided to it by the relevant law enforcement and intelligence authorities. It shall operate under the jurisdiction of the Commission for the Preservation of the New Order. ### § VII.5.02. Office for the Director of Imperial Prosecutions There shall be such a position as the Director of Imperial Prosecutions. They shall lead the Imperial Prosecution Service under the direction of the Chairman of the Commission for the Preservation of the New Order. ### § VII.5.03. It shall ensure that bodies within the Empire are conducting themselves lawfully and in line with the Imperial ideology and regulation. It shall operate under the jurisdiction of the Commission for the Preservation for the New Order. ### § VII.6.02. The Inspector General There shall be such a position as the Inspector General. They shall lead the Office of the Inspector General under the direction of the Commission for the Preservation of the New Order. ### § VII.6.03. Public Officers, Employees, and Records ## Chapter 1. Public Officers and Employees: General Provisions ### § VIII.1.01. Imperial Executor There shall be an Imperial Executor. The Imperial Executor functions as the Commander-in-Chief of all Imperial forces on behalf of His Imperial Majesty, The Emperor. ### § VIII.1.02. Grand Vizier There shall be a Grand Vizier. The Grand Vizier acts as the Empire's head of the Imperial Ruling Council and operates as the chief deputy of His Imperial Majesty, The Emperor. ### § VIII.1.03. Supreme Commander of the Imperial Military There shall be a Supreme Commander of the Imperial Military. The Supreme Commander of the Imperial Military is the most senior military officer within the Empire and operates as the operational leader of the Imperial Military. They are also head of the Joint Chiefs of Staff. ### § VIII.1.04. Speaker of the Imperial Senate There shall be a Speaker of the Imperial Senate. The Speaker of the Imperial Senate acts as the presiding officer of the Imperial Senate who is charged with ensuring the protocols and standing orders of the Imperial Senate are upheld. ### § VIII.1.05. Chairman of the Commission for the Preservation of the New Order There shall be a Chairman of the Commission for the Preservation of the New Order. The Chairman of the Commission for the Preservation of the New Order acts as head of the said government agency. He is also the head of the Commission's Select Committee. He operates to ensure that all public functions of the Commission operate effectively. ### § VIII.1.06. Procurator of Justice There shall be a Procurator of Justice. The Procurator of Justice shall be the head of the criminal justice system within the Empire. ### § VIII.1.07. Grand Moffs There shall be such a position as Grand Moff. The Grand Moffs shall operate as the chief regional governors of their respective oversectors. ### § VIII.1.08. Joint Chiefs of Staff There shall be a Council of the Joint Chiefs of Staff. This Council shall be made up the highest officers within each respective branch of the Imperial Military. They operate to advise the Supreme Commander of the Imperial Military and carry out every day functions of the same. ### § VIII.1.09. Moff There shall be such a position as Moff. The Moffs shall operate as the chief regional governors of their respective sectors. ## Chapter 2. Government Employment ### § VIII.2.01. Definition of Government Employment For the purposes of this Charter, "government employment" is defined as being employed in any of the agencies outlined in Title VII or any other department which His Imperial Majesty, The Emperor may proscribe as being under said description. ## Chapter 3. Vacating Office ### § VIII.3.01. Procedure An official may vacate their office by submitting a letter of resignation to their immediate superior and giving a minimum of two weeks notice. An official may only give less than the required notice period or no notice being given at all if the resignation was made in response to an order given by an immediate superior or in response to an emergency which required the resignation of the relevant official. ## Chapter 4. Commissions ### § VIII.4.01. Commissions All officers of the Empire are commissioned by His Imperial Majesty, The Emperor or any other such persons empowered by the same to do so. ## Chapter 5. Leaves of Absence ### § VIII.5.01. Procedure An official may be granted a leave of absence provided that they provide a reason for such leave being required, the request was made in line with the individual requirements of the branch, department or agency they work for and a reasonable notice period has been provided in the circumstances. ## Chapter 6. Powers and Duties of Officers ### § VII.6.01. Powers and Duties Officers of the Empire will have such powers and duties as set by their immediate superiors, relevant high command, the Imperial Ruling Council or His Imperial Majesty, The Emperor. ## Chapter 7. Public Records ### § VIII.7.01. Requirement to keep accurate public records All public bodies are required to keep accurate public records for the purposes of ensuring an up-to-date Imperial Archive available for public viewing. ### § VIII.7.02. Exceptions Any public bodies that are handling documents or any other information that is of a sensitive nature, the requirement for these to be made available for public viewing is removed. They do have to be submitted to the Imperial Archive.
